Terms and Conditions
Last Updated: September 8, 2026
Welcome to Lafayette Concrete & Remodel. These Terms and Conditions outline general terms that may apply to concrete, framing, remodeling, outdoor living, and construction services provided by Lafayette Concrete & Remodel in Lafayette, Indiana, Tippecanoe County, and surrounding areas.
Specific project details, pricing, payment schedules, scope of work, and other requirements may also be outlined in a separate estimate, proposal, construction agreement, scope of work, or signed change order. Where a separate written agreement exists, the terms of that agreement will apply to the specific project.
1. Scope of Work
Lafayette Concrete & Remodel will furnish the labor, materials, and equipment necessary to complete the work described in the applicable estimate, proposal, construction agreement, or Scope of Work.
Unless specifically included in writing, the following may be excluded from the original project price:
- Permits
- Engineering services
- Design services
- Utility locating beyond standard Indiana 811 public utility marking
- Dewatering
- Rock excavation
- Removal of unforeseen underground obstructions
- Additional work caused by concealed or unexpected site conditions
If additional work becomes necessary, it may be addressed through a written Change Order.
Work will be performed in a professional manner consistent with generally accepted industry practices.
2. Concrete Characteristics
Concrete is a natural construction material, and certain characteristics cannot be completely prevented.
These may include:
- Hairline cracking
- Shrinkage cracking
- Surface checking
- Minor scaling
- Efflorescence
- Color variations
- Texture variations
- Minor cosmetic imperfections
Lafayette Concrete & Remodel will use industry-standard practices for concrete placement, reinforcement, finishing, curing, and joint installation. However, we cannot guarantee that concrete will remain completely free of cracks or cosmetic variations.
Cracking or cosmetic variation that does not affect the structural integrity or intended function of the concrete will not normally be considered a workmanship defect.
3. Framing and Formwork
Where included in the project scope, Lafayette Concrete & Remodel may construct forms, falsework, and wood or metal framing required for:
- Footings
- Foundations
- Concrete slabs
- Walls
- Steps
- Flatwork
- Rough carpentry
- Other framing identified in the Scope of Work
Framing and formwork will be constructed using appropriate industry practices and materials suitable for the intended application.
Pressure-treated lumber may be used where framing is in direct contact with concrete, masonry, soil, or weather exposure when appropriate.
Minor variations in line, level, or plumb that fall within accepted construction tolerances and do not affect structural performance or intended function are not considered defects.
Natural wood movement, including warping, twisting, shrinkage, or cupping caused by environmental conditions, humidity, moisture, or temperature changes outside our control is not guaranteed against.
4. Estimates, Contract Price, and Payment
The total price for each project will be outlined in the applicable estimate, proposal, or construction agreement.
Payment schedules may include:
- An initial deposit
- One or more progress payments
- A final payment upon substantial completion
Deposits may be used to purchase materials and reserve project scheduling.
Once materials have been ordered or the project has been scheduled, deposits may become non-refundable except where applicable cancellation rights require otherwise.
The remaining project balance is due according to the payment terms contained in the applicable written agreement.
Minor punch-list items do not automatically delay final payment when the project has otherwise reached substantial completion
5. Price Adjustments
If the start of a project is delayed for an extended period due to circumstances outside Lafayette Concrete & Remodel’s control, including delays involving the property owner, permits, financing, or site conditions, we may adjust pricing to account for documented increases in material or project costs.
Any applicable adjustment will be communicated to the customer.
6. Change Orders
Changes to the original Scope of Work should be documented in writing and approved by Lafayette Concrete & Remodel and the customer before additional work begins.
Change Orders may include additional:
- Labor
- Materials
- Equipment
- Disposal
- Overhead
- Project time
Verbal instructions given to employees, crew members, or subcontractors do not automatically modify the original agreement.
Approved Change Orders may increase the project price and extend the project schedule.
7. Project Schedule and Delays
Any anticipated start or completion dates are good-faith estimates unless otherwise expressly guaranteed in writing.
Project schedules may be affected by:
- Weather
- Concrete curing requirements
- Permit delays
- Inspection delays
- Material shortages
- Supplier delays
- Labor shortages
- Customer-requested changes
- Actions of other contractors
- Unexpected site conditions
- Events outside our reasonable control
When these circumstances occur, the project schedule may be extended for a reasonable amount of time.
8. Property Owner Responsibilities
Customers are responsible for providing reasonable access to the project area and communicating known conditions that may affect the work.
Customers may also be responsible for:
- Providing clear and unobstructed job-site access
- Obtaining HOA approvals when required
- Identifying private underground lines not covered by Indiana 811
- Disclosing irrigation systems
- Disclosing invisible pet fencing
- Disclosing low-voltage lighting
- Disclosing septic systems
- Disclosing private drainage systems
- Informing us of known underground structures or obstacles
- Protecting or relocating personal property near the construction area
The customer is responsible for accurately identifying private systems that cannot be located through standard public utility marking services.
9. Concealed or Unknown Site Conditions
Construction sometimes reveals conditions that could not reasonably be identified before work begins.
Examples include:
- Buried debris
- Rock
- Unsuitable soil
- Undisclosed utilities
- Drainage problems
- Underground structures
- Previously concealed construction defects
If these conditions require additional labor, equipment, materials, or time, the additional work may be handled through a Change Order.
10. Lawn, Landscaping, and Property Damage
Construction work may require equipment, material delivery, excavation, demolition, and repeated access to the project area.
This may result in unavoidable impacts to:
- Grass
- Landscaping
- Driveways
- Sidewalks
- Irrigation systems
- Adjacent surfaces
- Other areas surrounding the project
Lafayette Concrete & Remodel will take reasonable precautions to minimize unnecessary damage.
Restoration of lawns, landscaping, irrigation systems, and other non-structural areas is the customer’s responsibility unless specifically included in the Scope of Work or damage results from proven negligence by Lafayette Concrete & Remodel.
11. Limited Warranty
Lafayette Concrete & Remodel warrants that covered work will be performed in a workmanlike manner and in accordance with agreed specifications for one (1) year from completion, unless a different warranty is stated in writing.
The warranty does not cover damage or defects resulting from:
- Natural concrete settlement
- Normal concrete cracking
- Concrete curing shrinkage
- Ground movement
- Abuse or misuse
- Lack of maintenance
- De-icing salts
- Chemical exposure
- Heavy equipment
- Freeze-thaw cycles
- Flooding
- Storms
- Environmental conditions
- Natural movement of wood or framing materials
Warranty claims should be submitted in writing during the applicable warranty period.
Unauthorized repairs, alterations, sealing, or other third-party work affecting our completed work may void the applicable warranty.
Unless otherwise agreed in writing, warranties are provided to the original customer and may not automatically transfer to a subsequent property owner.
12. Insurance and Licensing
Lafayette Concrete & Remodel maintains applicable liability insurance and workers’ compensation coverage as required.
Proof of insurance may be available upon request.
13. Nonpayment and Suspension of Work
Customers are responsible for making payments according to the agreed payment schedule.
If payment is not received when required, Lafayette Concrete & Remodel may suspend work until overdue balances are paid.
A suspension caused by nonpayment may result in:
- An extension of the project schedule
- Additional remobilization time
- Collection costs
- Applicable interest
- Other remedies permitted by law
Suspension of work because of nonpayment will not be considered a breach by Lafayette Concrete & Remodel.
14. Mechanic's Lien Rights
Where permitted by Indiana law, Lafayette Concrete & Remodel may have the right to file and enforce a mechanic’s lien against property for unpaid amounts relating to labor, materials, equipment, approved Change Orders, and other amounts properly due.
Customers remain responsible for amounts owed under their applicable construction agreement.
The company’s construction agreement also provides for interest on qualifying unpaid balances and recovery of certain collection-related expenses where legally permitted.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Lafayette Concrete & Remodel’s liability arising from a specific construction project may be limited as provided in the applicable written construction agreement.
Lafayette Concrete & Remodel will not be responsible for indirect, incidental, consequential, special, or punitive damages to the extent such limitations are permitted by law.
16. Indemnification
Where applicable under a signed construction agreement, customers may be responsible for claims or damages resulting from:
- The customer’s negligence
- Undisclosed site conditions
- Third-party interference
- Actions of contractors not under Lafayette Concrete & Remodel’s control
- Conditions outside our reasonable control
The specific rights and responsibilities of each party will be governed by the applicable written project agreement and Indiana law.
17. Termination
A construction agreement may be terminated if either party materially breaches its obligations and fails to correct the breach within the notice and cure period stated in the applicable agreement.
If a project is terminated, Lafayette Concrete & Remodel is entitled to payment for properly completed work, materials ordered, and applicable costs incurred through the date of termination
18. Dispute Resolution
Where included in the applicable construction agreement, the parties agree to first attempt to resolve disputes through good-faith mediation before pursuing litigation.
Any unresolved legal dispute will be governed by applicable Indiana law and handled in the court or jurisdiction identified in the signed construction agreement.
Attorney’s fees and costs may be recoverable where provided by contract or applicable law.
19. Photographs and Videos
Lafayette Concrete & Remodel may photograph or record project sites before, during, and after construction for purposes including:
- Project documentation
- Quality control
- Insurance documentation
- Recordkeeping
- Marketing
- Portfolio examples
Customers should notify Lafayette Concrete & Remodel in writing before work begins if there are specific concerns regarding the use of project photographs for marketing purposes.
Customers should also notify us of known pre-existing damage to nearby surfaces, structures, landscaping, or property before construction begins.
20. Subcontractors
Lafayette Concrete & Remodel may use qualified subcontractors to complete portions of a project.
Where subcontractors are used under our agreement, Lafayette Concrete & Remodel remains responsible for work performed by those subcontractors as provided in the applicable construction agreement.
21. Inspections
Where inspections are required before concrete placement, enclosure, or continuation of construction, customers may be responsible for coordinating inspections as specified in their project agreement.
Inspection delays or failed inspections resulting from conditions outside Lafayette Concrete & Remodel’s control may extend the project schedule and may result in additional costs when additional work is required.
22. Right to Cancel
Certain qualifying transactions may provide customers with a right to cancel within a specified period.
The construction agreement provided by Lafayette Concrete & Remodel includes a provision allowing the owner to cancel qualifying agreements before midnight of the third business day after signing, subject to the applicable cancellation notice and requirements.
Where a Notice of Cancellation is provided with a construction agreement, customers should follow the instructions contained in that notice.
23. Notices
Formal notices relating to a construction agreement should be provided in writing using a method permitted by the applicable agreement, which may include:
- Hand delivery
- Certified mail
- Email with confirmation of receipt
24. Severability and No Waiver
If any provision of these Terms or an applicable agreement is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Failure by either party to enforce a provision does not automatically waive the right to enforce that provision in the future.
25. Entire Project Agreement
The customer’s signed construction agreement, Scope of Work, exhibits, estimates incorporated into the agreement, and signed Change Orders constitute the complete agreement for that specific project.
Verbal statements or side agreements will not modify the written project agreement unless documented and approved in writing.
26. Changes to These Terms
Lafayette Concrete & Remodel may update these Terms and Conditions periodically.
Changes will be published on this page with an updated revision date. Changes to these website Terms will not modify an already executed construction agreement unless the parties agree to the modification as required by that agreement.
